Marriage Equality

Background

Referred to the ballot by legislative Democrats, Proposition 3 would reaffirm the right of same-sex couples to marry. This constitutional amendment from the Legislature would remove outdated language from Proposition 8, passed by voters in 2008, that characterizes marriage as being between a man and a woman.

IJ Action Recommendation

IJ Action strongly supports the right for people to marry whom they love, and for that right to be enshrined in our state constitution. Though the U.S. Supreme Court recognized marriage equality in Obergefell v. Hodges, archaic language not recognizing that right remains in California’s constitution. And given the rightward lurch of the Supreme Court in recent years, it is important for California to codify the right to marriage equality.
